Methodology: How We Analyze Injury Payouts
We collected payout information from actual car accident injury lawsuits filed in Alabama. Here we used a group of Alabama cases involving neck injuries, although victims may also have other types of injuries.
Ranges include the lowest and highest payout in the group of cases. Here we are using neck injury cases. When multiple accident victims are involved in the same lawsuit, we use the highest amount paid to one victim.
Average settlement payouts are calculated by adding all the settlement and court award amounts, then dividing the total by the number of cases. When the group includes an unusually high award, it can slant the average higher.
