Factors Affecting Arkansas Accident Payouts

The predominant factor in claim value is the severity of the accident victim’s injuries and the resulting medical costs, lost wages, and pain and suffering. T-bone accidents and other violent side-impact collisions can be catastrophic, especially for vehicle occupants on the side that takes the hit.

Because Arkansas is an “at-fault” state, accident victims have the right to file an injury claim with the at-fault driver’s insurance company or file a lawsuit against the at-fault party. Injured victims in Arkansas are not required to use their own insurance for injury claims, as they would in a no-fault state.

Arkansas law defines fault as “… any act, omission, conduct, risk assumed, breach of warranty, or breach of any legal duty which is a proximate cause of any damages sustained by any party…” 

Other important factors that can influence the final payout:

  • Crash Circumstances: Insurance adjusters (and juries) are influenced by the circumstances of a side-impact collision. Less money will be offered for an accident caused by someone backing into the side of a car in a parking lot than for a drunk driver who T-bones a car at high speed after running a red light.
  • Shared Fault: Arkansas is a modified comparative fault state, meaning that you can still make a claim so long as the other party is more at fault than you, and your payout can be reduced according to your percentage of fault. If you are equally or more to blame than the other party, you can be barred from receiving compensation.
  • Coverage Limits: Arkansas drivers must carry minimum liability coverage of $25,000 per person and $50,000 per accident for bodily injury, and $25,000 for property damage. The minimum coverage won’t be enough to cover severe injuries.
  • Multiple Claimants: Even when the at-fault driver or car owner has higher limits than the minimum required, it may not be enough to go around when multiple people are injured in a crash.
  • UI and UIM Coverage: Insurance companies are required by law to offer uninsured motorist (UM) and underinsured motorist (UIM) coverage to Arkansas policyholders, who have the right to decline those coverages. Without uninsured motorist coverage, there may be no funds available after an accident caused by a hit-and-run or uninsured driver.
  • Venue and Jurisdiction: Some courts have a history of large jury awards to car accident victims. In these jurisdictions, the insurance company will often pay a higher settlement to keep your case out of court.
  • Punitive Damages:  Punitive damages can only be awarded by a judge or jury in a court trial. Arkansas law limits punitive damage awards to the greater of  $250,000 or three times the compensatory award, not to exceed $1 million.

Case Summary: Plaintiff was driving. She entered an intersection and defendant struck the right side of plaintiff’s vehicle. Defendant continued on and struck several parked vehicles. Plaintiff said he suffered injuries to back, neck, and arms, shoulder, sternum and aggravation of disc problems. Defendant contended that plaintiff entered the intersection on a red light and that plaintiff was contributorily negligent in failing to maintain a proper lookout and in failing to exercise ordinary care. Jury returned a plaintiff verdict of $10,500. Per counsel, a witness stated that plaintiff had a green light and the fact that plaintiff’s vehicle was broadsided indicated that defendant was liable.

Head Trauma with Dizziness from Drunk Driver Hit-And-Run

When a case has more than one injured plaintiff, we used the highest award to a single injury victim to avoid overstating the payout one person might expect in similar circumstances. In cases with multiple accidents, we use the highest payout from one defendant paid to the accident victim.
