Case Summary: Plaintiff was driving his car during morning rush hour. Defendant rear-ended a vehicle in front of his vehicle and started a chain reaction. Plaintiff’s vehicle was the third vehicle in the three-car collision. Plaintiff said he suffered a compression of his spinal column and nerve roots in back requiring emergency surgery and possible future surgery to relieve further compression; and herniated cervical discs in neck requiring fusion. He claimed $ 1.3 million in loss of future income and past and future medical expenses. Defendants contended that: the accident was unavoidable; the accident was caused by a sudden emergency; and plaintiff was contributorily negligent. Plaintiff settled with the second driver for $90,000 prior to trial. Jury found for plaintiff and awarded him $200,000 against defendant.

Jury returned a plaintiff verdict for $375,000 plus prejudgment interest.

Passenger Loses Eye After Driver Hits Tractor-Trailer

Case Summary: Plaintiff was a passenger in a pickup truck operated by Defendant 1 on a road in a residential area. The road had two lanes of travel in each direction. A tractor-trailer owned by Defendant2 was parked on the road. Defendant 1 rear-ended the tractor-trailer. It was dark when the accident occurred. Upon impact, plaintiff was thrown forward in the truck where his face struck the windshield. Plaintiff subsequently lost his right eye. Defendant2 contended that Defendant1 had adequate room to pass the tractor-trailer and that Defendant1’s negligence was the proximate cause of the collision. Defendant1 contended that the accident would not have occurred if the truck had not been parked on the road. Jury returned a plaintiff verdict for $600,000 against Defendant1 and zero against Defendant2.

He also injured his spine, rendering him a quadriplegic. Defendant admitted liability but contended that plaintiff was contributorily negligent for not wearing a seat belt. Jury found for the plaintiff in the amount of $3,900,000.

Methodology

We analyzed a group of actual Maine lawsuits filed by plaintiffs injured in motor vehicle accidents. All plaintiffs in the group received a court award or settled their case before trial. In a few cases, the final payout was reduced because the injured plaintiff shared some blame for the accident. The Award amount reflects the net payout after adjusting for shared fault.

One catastrophic injury case with a $3,900,000 payout was not included in our averages calculations to avoid skewing the averages artificially high. The payout is included in the ranges.

Cases include collisions involving cars, trucks, and motorcycles. Victims include drivers, passengers, and a pedestrian, who was hit when the at-fault driver ran off the road.
