Plaintiff suffered fractured femur and pelvis, fractured ribs, lacerated liver and fractured elbow. He required surgical repair of his injuries and was out of work for seven months. Defendant contended plaintiff first turned on his turn signal and entered a right turn lane before continuing straight through the intersection after the truck driver had already begun entering the roadway. There was little dispute over plaintiff’s actual injuries, though defendant disputed the extent of plaintiff’s future damages and expenses. The jury awarded plaintiff $1,733,184 less 20% comparative negligence for a net verdict of $1,386,548.

Methodology

We analyzed a group of personal injury lawsuits filed in Georgia courts by plaintiffs injured in vehicle accidents. All the plaintiffs in our group received a payout from a court award or by settling with the defendant before trial.

In a few cases, the Award/Settlement Amount includes a small loss of consortium award to the victim’s spouse rolled into the injured plaintiff’s award. The award amounts also reflect any reductions for contributory fault, when applicable.

Averages are calculated by adding the payouts for a group of cases, then dividing by the total number of cases in the group.
