Defendant struck plaintiff’s vehicle on the passenger side while attempting a left turn, and was subsequently cited for failure to yield. Plaintiff suffered cervical disc herniation that required surgery. Her husband joined the suit, claiming loss of spousal consortium. Plaintiffs also sued for loss of parental consortium on behalf of their two minor children. Defendant admitted negligence but denied liability for the plaintiff’s damages. A jury found for plaintiffs and awarded plaintiff driver $12,896.01 for medical expenses, pain and suffering, and loss of body function. Jurors found in favor of plaintiff and awarded her a total of $208,200 in damages.

Methodology

We gathered a collection of actual lawsuits filed on behalf of Iowa car accident victims. We analyzed the ranges and average payouts for the entire collection, and broken out into sub-groups.

Averages are calculated by dividing the total settlement amount for a group by the number of cases in the group.

Payouts were grouped by:

  • Injury Severity – Minor, Moderate, and Severe
  • Injury Type – Neck and back injuries, Head injuries
  • Accident Type – Rear-end, Side-impact, and Head-on collisions

Neck and back injuries were combined into one sub-group because they often overlap.

When cases include more than one claimant, we used the highest settlement for a single accident victim in the analysis, to avoid overstating the payout for that case.
