How Car Accident Settlements Are Calculated
Under Minnesota law, all drivers must purchase no-fault coverage, also called Personal Injury Protection (PIP) or Basic Economic Loss Benefits. No-fault covers your medical costs, wage loss, and replacement services such as housekeeping. If you or a family member suffer fatal injuries, PIP pays $2,000 for funeral expenses.
No-fault claims are first made on your own PIP coverage. If expenses are greater than the PIP limit on your policy or exceed the no-fault thresholds, you can make a claim against the at-fault driver’s liability coverage.
Estimating a Payout for Minor Injuries
Minor to moderate injuries will be covered by your own Personal Injury Protection (PIP) coverage. The minimum PIP coverage is $40,000. That amount is available to each person injured in an accident as follows:
- $20,000 is allowed for medical expenses
- $20,000 may be used for non-medical expenses, like lost wages
PIP does not pay for property damage or pain and suffering.
You can estimate your payout by adding up your medical bills, out-of-pocket medical expenses, lost wages, and replacement costs, like hiring someone to shovel snow from your driveway.
Exceeding the No-Fault Tort Threshold
Severe injury claims that exceed the no-fault threshold are best handled by an experienced personal injury attorney. Your attorney will prove that your injuries meet the threshold criteria, pursue liability coverage from the at-fault driver, and gather evidence supporting your damages, including compensation for your physical and emotional suffering from serious injuries.
Injuries exceed the no-fault threshold when medical expenses are more than $4,000 or the injuries result in:
- Permanent disfigurement
- Permanent injury
- Disability for 60 days or more
- Death
Other factors that influence injury payouts in Minnesota:
- Shared Fault – Minnesota is a modified comparative fault state, also called the 51 percent rule. This rule means you can seek compensation from the other driver so long you are not more to blame than they are. Your payout will be reduced by your percentage of fault.
- Auto Policy Limits – Minnesota is a mandatory insurance state. Vehicle owners must carry insurance PIP coverage of no less than $40,000, liability limits of at least $30,000 per person/$60,000 per accident for bodily injury, and $10,000 for property damage.
- Multiple Claimants – When more than one person is injured in the same crash, there might not be enough liability insurance to fully compensate all the victims.
- Uninsured/Underinsured Motorist Coverage – Minnesota vehicle owners are required to carry uninsured motorist (UM) and underinsured motorist (UIM) coverage of $25,000 per person and $50,000 per accident. UM and UIM only cover medical costs.
- Commercial Policies – Insurance policies for commercial vehicles like tractor-trailers, tanker trucks, and delivery vehicles typically carry higher liability limits than personal auto policies. Higher limits can mean higher payouts for severe injury claims.
- Punitive Damages – Minnesota allows punitive damage awards only when the defendant acted with deliberate disregard for the rights or safety of others.

Methodology
We analyzed a group of actual lawsuits filed in Minnesota courts by car accident victims. All plaintiffs in the group received a payout through the court or an agreed settlement. Victims include adults and children.
In cases with more than one plaintiff, the award amount reflects the largest amount paid to a single plaintiff.
In some cases, the plaintiff was found to share some of the blame for the crash, and their award was reduced accordingly. The reduced amount is reflected in the Award/Settlement Amount.
