Defendant failed to stop and dragged plaintiff and his motorcycle for some distance. As defendant left the scene, plaintiff obtained his license plate number. Plaintiff’s counsel used private investigation sources and traced the automobile to defendants. Plaintiff suffered a traumatic near amputation of right foot resulting in 50% permanent partial disability of the right foot and ankle. Defendants admitted that defendant wife was the owner of the vehicle involved in the accident, but contended that they were not operating the automobile at the time of the accident. Jury returned a plaintiff verdict for $1,418,000.

Defendant contended he was startled by non-party vehicle, he reacted reasonably during the turn, did not see the plaintiff and the accident was not his fault. Jury found plaintiff was found 5% at fault and his award of $1,700,000 was reduced accordingly in judgment to $1,615,000.
