Methodology
We analyzed a group of North Dakota lawsuits filed by plaintiffs injured in vehicle accidents. Plaintiffs include drivers and passengers, and all were injured in rear-end collisions. All plaintiffs in the group received a final payout from a jury award or out-of-court settlement.
In some cases, the plaintiff settled for a smaller amount after a jury award. Settlements after a jury award are a compromised agreement to avoid the stress and expense of further litigation in appeals court.
The Award amount reflects the base payout paid to one individual plaintiff after a reduction for shared fault, if applicable.
Cases include collisions involving cars, trucks, and commercial vehicles, with injuries ranging from soft-tissue injuries to disabling neck and back damage.
