Over the next three months, plaintiff began to experience recurring headaches and suffered an unexplained near fainting episode a year after the accident. She was ultimately diagnosed with cyclic vomiting syndrome (CVS), a difficult to diagnose illness that produces periodic cycles of severe nausea and vomiting that last from hours to days with no other associative symptoms. Defendant’s expert testified that CVS could not be caused by the trauma plaintiff suffered when her head hit the windshield. The parties subsequently settled for $275,000.
