Wisconsin Car Accident Settlement Amounts and Case Examples

Explore payouts made to actual Wisconsin car accident victims. Look for cases similar to yours.

Wisconsin averages more than 30,000 injuries and 500 fatalities from vehicle crashes each year.¹

Wisconsin is a traditional fault state. When you are injured in an accident, you have the right to go after the at-fault driver and other liable parties for compensation. Other parties might be the vehicle owner (if not the driver) or the driver’s employer, if the driver was on the job when they caused the crash.

The average car accident settlement in Wisconsin for a moderate injury claim is $24,218. Average payouts range from $5,804 for minor injuries to $160,843 for severe injuries.

Average Wisconsin Car Accident Settlement Amounts

We analyzed a group of lawsuits filed in Wisconsin courts by plaintiffs who were injured in traffic accidents. Most lawsuits were against the at-fault driver, and a few other named parties, like the driver’s parents. All lawsuits resulted in a payout to the injured victim, either from a jury award or a settlement before trial.

How Car Accident Settlements Are Calculated

Insurance settlements for Wisconsin car accidents primarily depend on the scope and severity of injuries. Lawyers and insurance companies start by looking at the victim’s medical costs, then evaluate the claimant’s lost income and out-of-pocket expenses, and add an amount for pain and suffering.

Wisconsin is a traditional fault or “tort” state, so you can demand payment for all your damages from the at-fault driver. Most car accident cases start with a claim against the at-fault driver’s auto insurance. In tort states like Wisconsin, you can seek full compensation, even for mild to moderate claims.

Estimating a Payout for Minor Injuries

An easy way to estimate a fair payout for a minor to moderate injury claim is the “multiple method.”

First, add up your economic damages, like medical bills, lost wages, and out-of-pocket expenses for medications and replacement services. Then add one to three times the total of your economic damages to pay for your non-economic damages, commonly called pain and suffering.

A multiple of one is reasonable when you spent a few days on the couch with a heating pad on your back. A multiple of two or three is justified when your injuries disrupted your life for several weeks or months. For example, when disc surgery forced you to hire help to shovel snow all winter and kept you homebound during the holidays.

You need an experienced personal injury attorney to get the payout you deserve for severe or permanent injury claims. The attorney will locate eligible sources of compensation, and collect evidence proving your injuries, future medical costs, loss of earning capacity, and the physical and emotional suffering you’ve endured.

Other factors that influence injury payouts in Wisconsin:

  • Shared Fault – Wisconsin is a modified contributory negligence state, also called the 51 percent rule. This rule means you can seek compensation from the other party so long as you are not more at fault than they are. Your payout will be reduced by your percentage of shared fault.
  • Auto Policy Limits – Wisconsin is a mandatory insurance state. Vehicle owners must carry insurance liability limits of at least $25,000 per person/$50,000 per accident for bodily injury, and $10,000 for property damage.
  • Multiple Claimants – When more than one person is injured in the same crash, there might not be enough liability insurance to fully compensate all the victims.
  • Uninsured/Underinsured Motorist Coverage – Wisconsin vehicle owners are required to carry uninsured motorist (UM) coverage at least equal to the state’s minimum liability coverage. Underinsured motorist (UIM) coverage is not mandatory, but if selected must provide at least $50,000/$100,000 injury coverage per accident.
  • Commercial Policies – Insurance policies for commercial vehicles like tractor-trailers, buses, and delivery trucks typically carry higher liability limits than personal auto policies. Higher limits mean higher payouts for serious injury claims.
  • Punitive Damages – Wisconsin limits punitive damage awards to twice the amount of the plaintiff’s compensatory award, unless the defendant was operating a vehicle while intoxicated.

Methodology

We analyzed a group of actual lawsuits filed in Wisconsin courts by injured car accident victims. All plaintiffs in the group received a jury award or settled the case before trial.

Cases include two-vehicle collisions, single-vehicle crashes, and cases with pedestrians injured by moving vehicles. Plaintiffs include children and adults. There is one drunk driving case with a payout of $1,434,908 that is not included in the calculations to avoid skewing the averages artificially high.
In cases with more than one plaintiff, the “Award/Settlement Amount” reflects the highest payout to an individual plaintiff.
